  • In CDC bird flu mix-up, U.S. agency cites sloppy science, failed reporting 

    They said the U.S. Centers for Disease Control and Prevention (CDC) lab worker, who was not identified, allotted only about half the time necessary to carry out the procedures safely, and as a result samples of mild avian flu were tainted with a highly deadly strain and sent from CDC to researchers at the U.S. Department of Agriculture.

    CDC released the report of its investigation of the avian flu incident and said disciplinary action is under consideration. The agency is under congressional scrutiny over repeated safety lapses, including the potential exposure of scores of its workers to live anthrax bacteria in June.

    As serious as the sample mix-up, which occurred in January, was the failure to report it as required by federal law when the contamination became clear in May, according to biosafety experts. CDC did not report the incident until July.

  • Hundreds of bioterror lab mishaps cloaked in secrecy  More than 1,100 laboratory incidents involving bacteria, viruses and toxins that pose significant or bioterror risks to people and agriculture were reported to federal regulators during 2008 through 2012, government reports obtained by USA TODAY show.
    More than half these incidents were serious enough that lab workers received medical evaluations or treatment, according to the reports. In five incidents, investigations confirmed that laboratory workers had been infected or sickened; all recovered.
    In two other incidents, animals were inadvertently infected with contagious diseases that would have posed significant threats to livestock industries if they had spread.

    Ebola’s spread to the United States is “inevitable” due to the nature of global airline travel, but any outbreak is not likely to be large, US health authorities has said.

    Already one man with dual US-Liberian citizenship has died from Ebola, after becoming sick on a plane from Monrovia to Lagos and exposing as many as seven other people in Nigeria.

    More cases of Ebola moving across borders via air travel are expected, as West Africa faces the largest outbreak of the hemorrhagic virus in history, said Tom Frieden, the head of the US Centers for Disease Control and Prevention.

    A murder suspect’s silence during initial questioning by police can be used against him at trial, a sharply divided Supreme Court ruled Monday.

    The court’s more conservative wing ruled 5-4 that because Genovevo Salinas freely answered other questions while being questioned about two 1992 murders in Texas, prosecutors were free to use his refusal to answer one key question about the murder weapon.

  • Prosecutors exploit a suspect’s refusal to talk before invoking 5th Amendment rights against self-incrimination  

    Wading into a legally tangled vehicular manslaughter case, a sharply divided high court on Thursday effectively reinstated the felony conviction of a man accused in a 2007 San Francisco Bay Area crash that left an 8-year-old girl dead and her sister and mother injured.

    Richard Tom was sentenced to seven years in prison for manslaughter after authorities said he was speeding and slammed into another vehicle at a Redwood City intersection.

    Prosecutors repeatedly told jurors during the trial that Tom’s failure to ask about the victims immediately after the crash but before police read him his so-called Miranda rights showed his guilt.

    Legal analysts said the ruling could affect future cases, allowing prosecutors to exploit a suspect’s refusal to talk before invoking 5th Amendment rights against self-incrimination.

    “It’s a bad and questionable decision,” said Dennis Fischer, a longtime criminal appellate lawyer.

    Tom’s attorney Marc Zilversmit said he is deciding whether to petition the U.S. Supreme Court to take up the issue or renew his arguments in the state court of appeal.

    “It’s a very dangerous ruling,” Zilversmit said. “If you say anything to the police, that can be used against you. Now, if you don’t say anything before you are warned of your rights, that too can be used against you.”

The point is it really does not matter because the system is so corrupt you can never really be sure and there are corrupt motives involved that are political to begin with even indicting him. This is the pot calling the kettle black. Even if Perry is guilty, this is the abuse of Prosecutorial discretion which is the very same abuse but no prosecutor can be so charged because the Supreme Court gave them ABSOLUTE immunity to do as they like. The people in Ferguson can protest and demand criminal charges be brought against the policeman, but politicians are powerless – that is solely the discretion of a prosecutor who works hand-in-hand with the police. That is the entire problem.
